Much ado about T-O-U

Lately I've found myself addressing queries about how and how not to use my stocks. While I always try to include my TOUs individually in every zipped file or attach them as Artist's Notes in every dev I upload, I still continuously find myself addressing questions and concerns over their use. Too much precious time wasted. I decided to just post them here like the rest of the DA community.

Please read before you download any of my stuff. If there are STILL questions after reading this highly detailed TOU... if you still find yourself in doubt after reading, send me a NOTE. NEVER ASSUME that it is a "yes" or a "no." Thank you for your interest and your time

RULES:
All graphics and images contained in the kits and elements are copyrighted with ALL rights reserved. By downloading the digital file, you have obtained a license to use the kit or element for your own PERSONAL USE only, and you are required to abide by the terms of this license.

My work makes use of the work of other artists and it is not for me to issue commercial licenses on my own.

Please note that you are participating in digital piracy if you have downloaded these digital files and upload them in another site. Full legal action will be taken against you if you do so.

* use all graphics and images within the kits and all other downloaded elements for personal use but please give proper credit and a link back to my account.

* contact me if you are interested in commercial use policy. Note not all requests will be granted permission and in most cases will be granted only to those doing fundraisers or non-profit charity work. IF IT IS FOR CHARITY, NOTE ME. I WILL SEEK PERMISSION FROM THE CONCERNED ARTISTS WHOSE WORK IS INTEGRATED TO MINE. IF THEY GRANT THEIR PERMISSION TO YOUR REQUEST, I WILL AUTOMATICALLY ADD MINE AND YOU ARE FREE TO USE IT FOR YOUR STATED PURPOSE. This is not to make life difficult for you. I just would like to give proper respect to the artists whose work I deeply admire.

* alter the graphics in respect to size and coloration only. Credit is STILL required for any and all altered graphics or portions thereof.

* for DA prints? Note me. Chances are if you invested much time in your deviation and completely re-worked my stuff, it would be a yes. If it was a minor change such as recoloring, no. I prefer you go play with my stuff and "build on it"

- claim these graphics as your own.
- make stock out of my stock.
- alter the graphics in any way and then claim them as your own.
- redistribute these graphics in anyway, shape, or form.
- offer these graphics for download, resell, traded or shared regardless if they were on purchased, bought during a sale or downloaded as a complimentary selection
- use these graphics in any commercial endeavor, any paid digital work, service, website design, website template in whole or in part.
- use any part of any file in any content for any harmful, pornographic, or racial material or material that may be deemed harmful or offensive to the undersigned.
- use these files for obscene, defamatory, or immoral works or any other purpose which is prohibited by law. These files are licensed to your computer only and are NOT to be shared, loaned, rented, resold, distributed, transferred, or posted across a bulletin board, network, modem, Internet or web page. Do not make copies of these files on any electronic or physical medium (including CDs, diskettes, or other storage medium) for any reasons other than back-up purposes.
